The Deputy Secretary of Defense, who also serves as the DCO, has the authority to make these decisions based on new information received since the prior ARB. During ARB-4, the Deputy Secretary of Defense authorized the transfer of 24 detainees before their respective ARB-4 proceedings were complete.
One detainee was charged by the Office of Military Commissions, thus making the detainee ARB ineligible.
