Combatant Status Review Tribunal Summary

5 views 0 February 10, 2009 Updated on July 30, 2023

COMBATANT STATUS REVIEW TRIBUNAL SUMMARY
As of 10 February 2009

The Office for the Administrative Review of the Detention of Enemy Combatants (OARDEC) held 581 tribunals between July 30, 2004 and February 10, 2009. The tribunals determined that 539 detainees were properly classified as enemy combatants and 39 detainees were found to no longer be classified as enemy combatants.

The Secretary of Defense’s February 24, 2009 memo temporarily suspended Annual Administrative Reviews for Enemy Combatants detained at Guantanamo Bay, Cuba, to avoid duplicating the efforts of the review under the President’s Jan. 22, 2009 Executive Order.

A summary of the tribunal statistics to date is provided below.

Year Number of Tribunals Held Designated Civilian Authority Final Action Outcome
Enemy Combatant No Longer Enemy Combatant
2004 532 532 503 29
2005 26 26 17 9
2006 0 0 0 0
2007 14 14 14 0
2008 *7 3 3 0
2009 **2 3 2 1
Aggregate 581 578 539 39

*Three of the seven tribunals held in 2008 were a “New Evidence” CSRT. One of these CSRTs was placed in suspension, following the Secretary of Defense’s February 24, 2009 memo temporarily suspending Annual Administrative Reviews. A “New Evidence” CSRT is held due to receipt of new information that may affect a detainee’s initial enemy combatant determination.

**The two tribunals held in 2009 were placed in suspension, following the Secretary of Defense’s February 24, 2009 memo temporarily suspending Annual Administrative Reviews.
